The actual accounting of exactly how this conspiratorial group came together, along with the actual communication between the groups when they were setting up their second illegal raid (search and seizure ) of Kimball and his companies on May 12, 1993. The actual faxed communications were acquired from Dana Barnett (President of Somerset Pharmaceuticals and Vice President of Mylan Pharmaceuticals) when Mr. Barnett inadvertently provided Kimball's attorney at the time, with the wrong documents.

These communications were authenticated in court by the private detective agency's owner; Sean McWeeney, owner of Corporate Risk in Virginia . Sean McWeeney verified that the communications were between he and Dana Barnett and that he perjured himself when he testified against Kimball.

Note: When Kimball requested these documents be admitted into evidence for perjury, and to be compiled with a multitude of other evidence of violations of law and Kimball's constitutional rights; corrupt Judge Lazzara refused to admit any of the documents or other evidence Kimball had.

Federal prosecutor Phil Halpern Advises Investigator from Somerset that the FDA Appointed Dennis Deegan as the Person to Co-ordinate the use of FDA Personnel in the San Diego Operation that Made Jay Kimball and his Companies Principal Targets.

March 2, 1993, McWeeney to Barnett. Agent Perez calls Mr. McWeeney for Mr. Halpern and advises him of new FDA players to get Mr. Kimball and DEDI. Dennis Degan from FDA Headquarters is assigned to assist Mr. Halpern by Associate Commissioner of the FDA, Mr. Chesmore. Agent Perez gives McWeeney updates on the government’s investigation of Mr. Kimball and DEDI. McWeeney also relates a conversation with Don Leggett from the FDA. Also in this letter is Somerset’s conspiracy with government officials to stop Interpharm’s deprenyl product from entering the U.S. while depicting Somerset’s government infiltration in Canada to stop Interpharm’s sales of a deprenyl product in Canada.

Mr. McWeeney discusses with Mr. Barnett to bait selected Interpharm personnel in an attempt to extract incriminating statements that can be taped. Mr. McWeeney continues on to say, in essence, that the FBI wants to get Mr. Sherman and Mr. Shechtman from Interpharm in the U.S. to arrest them. Mr. McWeeney goes on to say that once Sherman and Shechtman are in the U.S., Chris Meade, Assistant U.S. Federal Prosecutor, will “arrange” indictments. The questions here is, how do you “arrange” indictments? As indictments come from a grand jury, and only prosecuting attorneys control the grand jury, do you lie to the grand jury? Pay some of them off? Or do you just issue an indictment by a grand jury that does not exist? Click for letter.

Letter to Dana Barnett from Investigator Advising him that the FDA and Florida FDLE has Kimball, his Companies, and Home Under Surveillance

March 23, 1993, McWeeney to Barnett. Another new government player arises that Somerset has allied themselves with as McWeeney speaks with U.S. Customs Supervisor Jose Cordova, as he advises McWeeney that a joint effort has been conducted between the FDA and the Florida Department of Law Enforcement (FDLE) keeping Mr. Kimball under surveillance. While they were surveilling Mr. Kimball at home, they saw unknown investigators take Mr. Kimball’s trash. McWeeney lies to Cordova, which you will see in the next March 26, 1993 letter, and states that Somerset does not have any overt (clandestine) activities going on with Kimball. Sandoz Pharmaceuticals enters the picture to help out Somerset and the Government. The letter goes on to describe meetings with the FBI and others as Somerset’s conspiracy with government officials to put Interpharm out of business and put the heads of the company in jail.

This letter and the previous ones to Mr. Barnett clearly reveal that McWeeney, i.e. Somerset, their attorneys Nan Mantell, Gunster and Yoakley, the Board of Directors of all the pharmaceutical companies are united as one with just about every government law enforcement agency, as is Bristol-Myers Squibb who is mentioned throughout McWeeney’s correspondence. Employees from these government agencies now include the U.S. Justice Department, the FBI, the Secret Service, the FDA, the DEA, U.S. Customs, the Florida Department of Law Enforcement, the Florida Department of Health and the Canadian equivalent to our FBI. At this point, certain facts need to be brought forth. Somerset Pharmaceuticals is essentially a paper company with relatively few employees, which is owned by large pharmaceutical companies. The FDA gave Somerset patent type rights for a deprenyl type product called Eldepryl. The only product Somerset offered was Eldepryl. Eldepryl, from 1989 to 1994, was made in Budapest, Hungary and imported by Somerset for sale and distribution in the U.S. and Canada. Deprenyl is a generic name, such as a tree, a bush, a plant, etc. Each are made up of different components which produce different results.

Clove and parsley are plants, so is poison ivy. Deprenyl is a name for many products or chemical ingredients that contain a common base. Some deprenyl products may save your life, while others can debilitate you and cause death. Somerset’s deprenyl product, Eldepryl, in 1992 sold for between $120.00 - $150.00 per bottle for 30, 5mg tablets, totaling 150mgs. The cost to manufacture this product in pill form should not have exceeded $1.00 for 30 tablets, especially considering the purity of the imported Eldepryl was deplorable. Test results will reveal, on a different link in this site, just how severe the contamination really was of the imported Eldepryl. Liquid Deprenyl Citrate with stated purity levels well over 99% sold for $75.00 for double the amount, 300mgs. Interpharm’s deprenyl product also sold for much less than Eldepryl.

By 1996 Somerset had received in revenues, close to one billion dollars by fleecing the public and insurance companies with overcharges. Somerset did not have any huge expenses in the development of Eldepryl or FDA approval as the product was developed over 30 years ago in Hungary and FDA approval trials were paid for by non-profit organizations and government funding. The FDA, in essence, had given Somerset patent rights for Eldepryl for 5 to 7 years for a product Somerset never developed nor paid for the trials necessary to gain FDA approval. The FDA gave Somerset, Mylan, Bolar and Sandoz Pharmaceuticals the exclusive distribution rights to Eldepryl, a license to rob the public at its discretion and they all did. The FDA did this knowing, as did the pharmaceutical companies themselves along with other government and state employees assisting Somerset, that Eldepryl was contaminated with controlled substances along with other contaminants.

It was illegally imported, distributed and sold to the compromised public afflicted with a debilitating disease, Parkinson’s, in violation of DEA controlled substances law. These issues, and the proof thereof, will be clearly depicted in other links in this site. The very sad fact is that this is just one of many such cases where a multitude of Government employees were involved in a conspired effort to assist Somerset and the FDA in eliminating its competition so that patients in dire need with terminal afflictions may only receive the one contaminated, over priced deprenyl product, Eldepryl. The results of all those government employees efforts is suffering and death caused by agents protecting a contaminated FDA approved drug illegally sold to people afflicted with a terminal disease. Leggett From the FDA Calls Somerset INvestigator McWeeney Looking for Help

March 26, 1992, McWeeney to Barnett. Aside from mentioning Bristol-Myers Squibb in their ongoing conspiracy efforts with government agents, McWeeney states he forwarded Kevin Black’s information to U.S. Customs Special Agent Steve Perez. Kevin Black was a private investigator used by Somerset’s attorneys Gunster and Yoakley to investigate Mr. Kimball and DEDI, a fact which came out in Mr. Kimball’s trial of 2000. It was well presumed to be Kevin Black that took Mr. Kimball’s trash and McWeeney knew it when he denied the same to government agents.

McWeeney went on to say that the FDA wanted Somerset as experts to provide health dangers of unapproved drugs for the Justice Department and Mr. Halpern. That’s very odd for the FDA to ask the producer of a highly contaminated FDA approved drug, Eldepryl, to give Mr. Halpern an expert opinion on someone else’s product when the FDA knew all the time Eldepryl was contaminated.
