8. James T. Kimball - BOP #38591-018
The Truth is revealed herein by Kimball, as Kimball is willing to submit to a professional truth serum and/or polygraph, as are all other victims and witnesses referenced herein. Further Kimball swears, under the penalty of perjury that all statements made within this article are true and correct to the best of Kimball's knowledge and belief. Kimball holds an abundance of proof, available for public viewing as to the accuracy of the contents of this article.
Prior to the fall of 2000, Kimball was the president of Discovery Experimental and Development, Inc. (DEDI), and ASTAK, Inc. DEDI being a licensed pharmaceutical research company and ASTAK being a licensed dietary supplement research and production company. Both companies were forced out of business by the pharmaceutical industry, the Food and Drug Administration (FDA) and specific federal judges.
Kimball at 60 years old had never been charged with a crime in his lifetime.
However, in the fall of 2000 Kimball was placed in prison after being found guilty in a Federal kangaroo court, due only to the fact that Kimball was exposing the corruption between the pharmaceutical cartel; the FDA; the Florida Department of Health and the U.S. Justice Department. That is a different accounting and is not put forth herein. The accounting of Kimball's rigged trial may be found under James T. Shortly after Kimball was placed in jail in Tampa, Florida awaiting transfer into the Federal prison, Coleman/Low (CL) in Coleman, Florida; Kimball was unwarrantedly transferred to another Florida state jail in La Belle, Florida. During the trip from Tampa to La Belle, Kimball sustained injuries to his neck and shoulder due only to the deliberate acts of the US marshals that transported Kimball. The conditions in La Belle jail were so deplorable that Kimball contacted a serious upper respiratory infection within 2 days. Kimball had not been seriously sick in his lifetime; was the picture of health, played tennis consistently and had no physical ailments or disabilities.
Within five days at La Belle jail, Kimball was unable to speak or breathe properly and was rushed back to the Federal jail in Tampa for medical treatment. Once in Tampa, Kimball began to receive medical treatment and began to get better, however, before he fully recovered, Kimball was transferred yet again to a state jail in Brooksville, Florida. Prior to receiving medical treatment at Brooksville, Kimball was again transferred this time to Coleman/Low (CL) Federal prison in Florida.
Kimball had brought with him the medications prescribed by medical doctors in Tampa for his serious upper respiratory infection. Upon arrival at CL all Kimball's prescribed medications were removed by an unlicensed physician's assistant (PA) who was an employee of the medical department at CL named Urriste.
Kimball immediately complained about the removal of his needed medications. PA Urriste advised Kimball he would not see a medical doctor at CL for at least three months. Then Kimball was placed directly in the hole at CL deprived of all antibiotics.
Once released from the hole, Kimball was eventually sent to CL medical due to his constant coughing problem (approximately 600 times a day) and restricted breathing problem. CL medical would do nothing for Kimball's upper respiratory infection nor Kimball's neck and shoulder injury sustained by the US marshals.
Kimball and his family, knowing he was in serious medical condition, requested Kimball's private medical doctor visit and examine him at CL. Kimball's private physician diagnosed Kimball with a serious upper respiratory infection and recommended a strong antibiotic. This information was forwarded to the Warden and medical department at CL, and fell on deaf ears. Kimball's family contacted Senators who in turn contacted both CL and BOP personnel in Washington, D.C. attempting to get medical treatment for Kimball. All to no avail, as the BOP constantly lied in writing to the senators about Kimball's medical condition and treatment.
As the months went by Kimball and his family knew he was dying and there was nothing anyone could do about it. Kimball's attorney prepared and filed with the Ocala Federal Court, a request for a restraining order in an attempt to acquire medical treatment for Kimball. The Ocala court refused the injunction within one day of it being filed. Rest assured if a federal prosecutor asked the Federal court in Ocala for a restraining order against a private medical doctor for non-medical treatment of a Government employee, the court would have issued the order in a second.
By this time Kimball had degenerated to using an abuterol inhaler to assist his breathing and had trouble walking due to his weakened condition. Over 3 months after Kimball arrived at CL, Kimball was taken to see one of the alleged medical doctors at CL, a Dr. Davila, who told Kimball he was fine and refused to give Kimball an antibiotic for his constant coughing.
Kimball found out later that none of the alleged PA's or alleged medical doctors at CL medical were licensed or board certified to practice medicine in any of the 50 states within the United States. In fact few could write English; understand spoken English, or speak English well. Some could not read English at all, yet they were interpreting written sick call slips, determining what was wrong with prisoners and prescribing medicine.
Kimball was advised that demanding medical treatment and filing legal action to acquire medical treatment causes the BOP to retaliate swiftly. While Kimball's legal action was underway against CL medical, CL placed Kimball in the hole again on contrived charges and took away all Kimball's medications to include his inhaler.
The BOP had invented a charge against Kimball and his attorney claiming Kimball with the assistance of his attorney, during attorney visits were bringing into CL contraband in the form of legal papers, paperwork and paper material. Kimball not only had permission in writing from CL to exchange paper materials, BOP policy states that a prisoner is allowed to exchange legal materials during attorney visits as does Federal Law, Rules and Regulations. The charge was deliberately bogus, done in retaliation against Kimball and his attorney for demanding medical treatment and filing in court against the BOP in an attempt to acquire medical treatment for Kimball.
Kimball's attorney visits along with family visits were immediately cancelled and Kimball was refused all telephone calls when he was placed in the hole. Kimball knew he was dying and knew that by his medications being taken away along with his placement in the hole, that the BOP had decided that was where Kimball was to die.
It's a very strange feeling knowing you are placed alone in a 4' X 7' cell to die. Kimball barely able to breathe survived the 14-day ordeal and attributes his survival to a higher authority. The treatment Kimball received while he was in the hole was at best, inhumane and against a multitude of laws. While Kimball was in the hole, he was taken to a hearing before Officer Jeffrey Bryant and found Kimball guilty of having unauthorized paper legal materials. The BOP had violated Kimball's right to due process and an abundance of other laws in the process of finding Kimball guilty. Officer Bryant absolutely refused to allow Kimball to produce witnesses in his favor. Kimball was advised by his unit team - Mr. Upchurch and Mr. Vasquez at CL prison that they were ordered by Warden Swope and Captain Evans to recommend harsh punishment.
Just prior to Kimball's release from the hole, a Lt. Lewis told Kimball the BOP can put anyone in the hole they don't like, under the guise of an investigation for 90 days and have them killed; simply by putting a mentally deranged prisoner in the same cell to kill the other prisoner. Lt. Lewis who was the officer in charge of the hole did exactly that the day before Kimball was released from the hole by his unit team.
It was about this time that Senator Nelson, Senator Harkin and former Congressman Berkley Bedell sent in a joint inquiry to CL about Kimball's medical condition and Kimball was taken to an outside specialist to determine what was wrong with Kimball. The outside specialist found that Kimball's continual coughing gone untreated had caused Kimball's larynx, vocal cords and voice box to become enlarged while causing polyps to develop in Kimball's throat. The specialist recommended antibiotics and a biopsy.
Even with the specialist's recommendation for Kimball to be given antibiotics after Kimball's medical doctor months prior had recommended the same the BOP refused to prescribe any to Kimball.
Kimball spoke with many inmates and candidly with one PA at CL. Kimball was advised that the BOP selectively picks which prisoners will receive medical treatment and which ones will not. Also that the deliberate lack of medical treatment to certain prisoners kills them. Kimball began interviewing and keeping a record of the prisoners the BOP selectively picked not to provide medical treatment for; and there were many. The names of the prisoners Kimball is aware of, that underwent torture; some dying under such medical torture, is depicted on this web link.
The prodding from the three senators had worked to an extent and Kimball was taken out for a biopsy and removal of growths in his throat that were blocking his breathing passage.
The first operation had to be aborted during the procedure when the operating doctor discovered, that because the operation had been put off by the BOP for months, the growths had increased in such size, if he installed a trachea tube while Kimball was sedated, he might suffocate and die. Kimball was awakened by the doctor after the aborted operation and told by the doctor what had transpired due to the lack of immediate treatment by the BOP. The doctor advised Kimball he had to install a trachea tube while he was awake to perform the operation. The doctor's office advised Kimball that the situation was dangerous and that the second attempted operation would be in a few days. However, the BOP postponed the operation for 3 weeks placing Kimball's life at risk again; while torturing him as he was gagging a good percentage of the time.
The second operation was a success; however the surgeon told Kimball again, he did not know how to address his breathing problem caused by the enlargements in his voice box, larynx and vocal chords caused by his untreated upper respiratory infection and chronic coughing.
Two months prior , while Kimball was initiating legal actions against the BOP, Kimball had a crown fall off one of his teeth and requested a cavity be filled in another tooth. Kimball put forth a number of requests. Coleman/Low medical (CLM) refused to even look at Kimball's teeth or glue back on the crown. Kimball asked his personal dentist to come in and look at him which he did; however, his personal dentist could do nothing for him as the BOP refuses to allow any medical or dental treatment from a prisoner's personal doctor.
Within a few weeks after Kimball's successful throat surgery Kimball became nearly incapacitated due to a serious infection caused by an abscessed tooth that the BOP refused to even look at. The infection had spread throughout Kimball's body. Kimball was given penicillin and told he needed oral surgery by the BOP and they would do it at CLM. Kimball asked if the BOP had oral surgeons at CLM. The reply was no! However, they were capable of doing such surgery at CLM and had done so before. Kimball had heard about the horrors done to inmates in the dental department of CLM and requested the dental surgery be done by a licensed oral surgeon.
The BOP delayed and kept Kimball on penicillin to starve off the continuing infection until senatorial inquiries came in again, and Kimball was taken to an oral surgeon that removed 4 teeth. Kimball lost four teeth only because the BOP refused to glue on a crown and fill a cavity notwithstanding the serious immobilizing infection which again placed Kimball's life at risk again.
Shortly after Kimball's throat surgery and before Kimball's oral surgery Kimball was placed in the hole on contrived charges just as Lt. Lewis advised Kimball would happen to prisoners the BOP didn't like. The BOP had falsified documents which Kimball has and invented an investigation accusing Kimball of taking medication during a visit from his wife and son. The BOP again cancelled Kimball's attorney visits and all other visits for Kimball from his family and friends. The people involved that worked for the Government in this illegal invented investigation, consisted of, but not limited to: BOP Regional Director R. E. Holt in Atlanta, Georgia, Warden Swope, Warden Killian, Captain Evans, Lt. Lewis, Lt. Rogers, Officer Keesler, Officer Carlson, Officer Ratcliff all working at Coleman/Low Prison in Coleman, Florida.
The treatment Kimball received in the hole this time surpassed the inhumane treatment Kimball had encountered previously when placed in the hole on contrived charges. In the over 100 days Kimball was placed in the hole by the aforementioned Government employees, those named Government employees again falsified documents; falsified charges; placed Kimball in a cell invested with red ants; turned out the lights in Kimball's cell and put wire in Kimball's food; forced Kimball to carry heavy bags (handcuffed) until he collapsed; refused Kimball legal telephone calls; confiscated Kimball's legal work and searched through all of it; forced Kimball to eat on the floor of the strip cells in the hole; refused to provide Kimball his legal materials and use of the law library were among just a few of the illegalities these Government employees perpetrated against Kimball while he was in the hole. Kimball has sworn declarations by witnesses.
Regarding sanitary and medical issues while Kimball spent over 100 days in the hole, these named Government employees again confiscated all Kimball's medication refused to treat a growth on Kimball's foot due only to the conditions Kimball was under in the hole; refused Kimball clean clothes daily, provided Kimball with useless shower facilities and even refused Kimball a pillow.
All the aforementioned are violations of law, notwithstanding inhumane treatment by the aforementioned Government employees. Kimball notified the BOP of the treatment to himself and others. Kimball also notified the Office of Investigative General (OIG) which investigates illegal activities by the Department of Justice employees which everyone named above is part of. No one would do anything.
The criminal laws governing the Justice Department employees in which the BOP is part of, which were violated against Kimball and other selected prisoners, are a farce and only words on a piece of legal paper to further public propaganda.
At about 90 days in the hole receiving inhumane treatment daily, Kimball was notified he was being transferred to a punishment prison in Yazoo, Mississippi. Kimball was told by Captain Evans and his counselor, Mr. Upchurch and Unit Manager, Mr. Vasquez, he was being transferred, because Kimball at 62 years old, was a threat to some unidentified prisoner at Coleman/Low. This was put in writing by Upchurch, Vasquez and Warden Killian. Kimball was transferred shortly thereafter to the punishment prison in Yazoo. The people that instigated the phony pretext for Kimball's transfer were: BOP Regional Director R. E. Holt, Warden Swope, Warden Killian, Captain Evans, Counselor Upchurch and Unit Manager Vasquez at Coleman, and Officer Ratcliff. No charges were ever filed against Kimball.
Subsequent to Kimball's transfer to the punishment prison in Yazoo, the BOP was caught up with their consistent lying in writing. When Kimball arrived at Yazoo he was told by his unit team a number of times his BOP file read; he was transferred for positive institutional adjustment. Then he was told in writing he was transferred for closer supervision. Then in a legal action by Kimball the BOP answered in writing that he was transferred because of taking medicine at visit and the investigation was turned over to the FDA. Then when Yazoo prison, a year and a half later, recommended Kimball be transferred to a prison camp in Pensacola, Florida, Regional Director R. E. Holt refused the prison's and Warden's request saying Kimball still needs to remain at the punishment prison in Yazoo for closer supervision. Even though there were no incidents against Kimball contrived at Yazoo in a year and a half. When a senator sent in an inquiry to the BOP as to why Kimball was not transferred away from Yazoo as requested by Yazoo Prison; Regional BOP Atlanta Director R. E. Holt wrote a letter back to Senator Nelson naturally lying and stated in essence, Kimball needs to remain at Yazoo for close supervision because he may possibly have been involved in taking medicine two years ago at Coleman/Low at visit.
While Yazoo Prison did not directly and consistently fabricate charges against Kimball, Yazoo Medical (YM) continued to refuse to treat Kimball medically and caused Kimball's medical conditions to degenerate causing continual serious pain and suffering on a continual basis.
After Kimball's arrival at Yazoo in March of 2002, Yazoo medical refused to treat and remove the growth on Kimball's left foot caused by the BOP. The specialist that looked at Kimball's growth in 2002 told Kimball it is a simple operation to remove the growth, however, the BOP would not allow him to do it. Kimball's continual pain from the growth causes Kimball to limp for almost 2 years.
Although the BOP after over two years finally had MRI's and x-rays of Kimball's neck and shoulder injuries, the BOP flatly refused professional medical treatment for the constant pain or any correctional therapy.
Kimball became gravely ill at Yazoo Prison caused by YM refusing to diagnose and treat a kidney stone which had incapacitated Kimball with pain and Kimball had to be taken to YM in a stretcher. When Kimball arrived for the second time at YM with severe debilitating pain from the kidney stone, no diagnosis was offered, no treatment given, other than medication to subdue the pain. After Kimball was given pain medication he was put directly in the hole, placed on a steel flat bed with no mattress or pillow and left there.
The following day Kimball was released, and never seen by YM. The untreated and undiagnosed kidney stone caused a severe infection which incapacitated Kimball again. This time YM gave Kimball an antibiotic for fear of Kimball dying yet refused to have Kimball professionally diagnosed and treated for the kidney stone Kimball had. Months passed while Kimball suffered severe pain and bleeding from the kidney stone ripping through his body, yet YM would offer no diagnosis or treatment. Approximately 7 months after being taken to YM on a stretcher, Kimball extracted the kidney stone himself with a needle and tweezers. The stone was immediately sent to Kimball's representatives who currently have the stone.
Most recently Kimball had another crown come loose on one of his front teeth. An incompetent dentist at BOP medical at Yazoo, glued the crown on crooked. This in turn caused the tooth to break off at the gum line. Currently as of February 2, 2004 with BOP already notified of the problem, what the BOP is going to do about the problem they caused.
Kimball was sent from Yazoo Federal Prison in Mississippi to Texarkana Federal Prison in Texas in retaliation by the BOP, for putting on this website the truth about the torture and death ongoing at Yazoo Prison. Some of the BOP's inhumane acts which resulted in torture and death are depicted on this website under this web link.
1. The final straw was when Kimball posted on his website a December 6, 2004 recap of BOP accounts on this website. After the December 6th news updates; the posting was placed on the locked Bulletin Boards all over the Yazoo Prison's compound, to include Yazoo Prison's Medical Bulletin Board. Kimball was thrown in the hole; tortured; and told by Warden Reese and Deputy Captain Whittington that he was put in the hole because the website posting Kimball wrote, appeared on Yazoo's locked bulletin boards. It was obvious that both Warden Reese and Capt. Whittington knew Kimball could not post the website article on Yazoo's Bulletin boards as Kimball did not possess a key to open the locked bulletin boards that were encased in plexiglas with key locks. Warden Reese and Whittington invented a reason to put Kimball in the hole stating in writing, that Kimball encouraged inmate to participate in a riot. Of course that charge was just another phony contrived charge, the BOP had continually perpetrated against Kimball and many other prisoners throughout the Bureau of Prisons.
The investigation report that was written was a phony from the start.
Let's look at the Phony BOP Document
2. At the top left of the document it depicts a corrupt Lieutenant A. Bobbitt wrote up this bogus investigation report and checked off (b) is pending investigation of a violation of Bureau regulations . Then toward the bottom after (g) the report states "you were placed in Administrative Detention (fancy name for the hole) pending an SIS (stands for the BOP's "Secret Investigative Service" ) investigation for trying to encourage inmate to participate in a riot." And at the bottom of the contrived report it is signed by Officer Imar Randle that he witnessed this phony document given to Kimball on December 15, 2004. The problem with that false statement by Officer Imar Randle is at the top right side of the report where it clearly states the time and date the report was allegedly written was December 20, 2004 at 2:30 PM. The time that Kimball was called to corrupt Lieutenant Bobbitt's office, handed a copy of this exact report by Lt. Bobbitt and placed in the hole at Yazoo Prison. It states directly above Officer Randle's signature at the bottom, that inmate (Kimball) received a copy of this order on Dec. 20, 2004 at 2:30 PM which is absolutely correct; then goes on to state by signature that Imar Randle witnessed this action on Dec. 15, 2004.
Now how could Officer Randle witness on Dec. 15, 2004 something that didn't happen until 5 days later. Not only that when evil Bobbitt gave Kimball this report, no one saw Bobbitt give the report to Kimball as Lt. Bobbitt stuck this report in Kimball hands after he was handcuffed with his hands behind his back, while Bobbitt refused to let Kimball read the report until after Kimball was placed in the hole.
3. Kimball believes he knows exactly how this bogus report was generated. The Dec. 6, 2004 news update was placed behind the locked bulletin board under plexiglas on December 15, 2004. An elite group of corrupt BOP officials comprising of Regional Director R. E. Holt , Warden Reese ; Captain Whittington ; Lieutenants Bobbitt and Grider ; came up with the idea of putting Kimball in the hole on December 15, 2004 made up the phony report and had corrupt Officer Randle witness it was given to Kimball that day of December 15, 2004. However, someone had second thoughts quite possibly Regional Director R. E. Holt, and didn't give the OK for Kimball to be thrown in the hole as retaliation until December 20, 2004. The report had been sitting around since Dec. 15, 2004, signed as delivered to Kimball; that he was placed in the hole on Dec. 15, 2004, which never happened . Then merely added the Dec. 20, 2004 date at 2:30 PM when Kimball really was placed in the hole, as that portion of the report was left blank. However Randle and Bobbitt's signatures were placed on the document Dec. 15, 2004.
4. After almost a month in the hole being tortured by Lt. Grider; the lieutenant in charge of the hole, obviously by orders of Whittington and Warden Reese; Kimball was released from the hole, directly after a threatening letter was sent by a news writer and editor to Warden Reese and head of the BOP, Harvey Lappin. CLC has this letter, however as of this date, the news writer has not given his consent for the publication of his missive.
5. Upon Kimball's release from the hole, Kimball was advised by middle staff at Yazoo; that Prison Staff had put the website news update on Yazoo's medical bulletin board. And that they apologized to Kimball that he had been retaliated upon; as they were only trying to help rid Yazoo of the ongoing medical torture and death there. Kimball was also informed that he was not scheduled to be released from the hole until BOP region (R. E. Holt) transferred Kimball out of his region. The news editor's letter had thrown a monkey wrench into presumably R. E. Holt's retaliation plans to get Kimball out of his region permanently.
Kimball was also advised by middle BOP staff that while Kimball was in the hole; the entire BOP medical system policy was changed and all prisoners at Yazoo that were classified as medical #2 or higher were to be transferred to other institutions to receive medical treatment.
After years of needless death and torture the BOP does something
6. Three years of efforts from this website, caring staff at Yazoo, prisoners such as Kimball complaining and news articles being written; the BOP decides to act and attempt to correct very serious torture and murder which has gone on throughout the Federal Bureau of Prisons for decades. This BOP attempt; if not just superficial ; is one very small step in the right direction, to correct the ongoing torture and murder of prisoners running rapid throughout the BOP. Retaliation and torture has been; and is in full force today, implemented against most every BOP prisoner that attempts to acquire either their constitutional rights, human rights; or attempts to expose the BOP for their voluminous amount of US laws they violate and inhumane acts the BOP inflicts upon defenseless US prisoners.
7. The last thing BOP staff told Kimball was; that while Kimball was in the hole at Yazoo; high BOP staff, presumably Regional Director R. E. Holt, Warden Reese, Capt. Whittington, non-medical doctor and clinical director Anthony Chambers and others decided to change Kimball's medical classification from a #1 to a #2 to justify transferring Kimball out of R. E. Holt's region to get rid of him. Kimball knew many of the prisoners being transferred. The majority went to Florida and were from Florida where Kimball was from. The few that the BOP didn't like such as Kimball that were red flagged were shipped further away from home.
8. To summarize; it is obvious personnel within the BOP conspired to get Kimball in the hole as a pretext, torture him while in the hole, change his medical status while he was in the hole and transfer him away from R. E. Holt's region because he was exposing Holt's ongoing torture and murder at Yazoo. BOP Regional Director Holt and the rest of his gang members , accomplished their mission with one minor skirmish lost, they feared exposure in the press and let Kimball out of the hole due to the threatening letter from a member of the press.
Kimball was transferred to Texarkana Federal Prison in Texas, 1,000 miles from his home.
As of the date of this accounting, June 2005, Kimball holds a multitude of substantiating proof of the following:
- That the BOP selectively picks whom will receive proper medical care and who will receive none.
- The BOP selectively picks which inmates they will retaliate against; while in the process of retaliation, the BOP inflicts torture and inhumane treatment as standard treatment along with premeditated attempted murder and the murder of prisoners; totally covered up by the BOP.
- Most every prisoner will be retaliated against for filing legitimate lawsuits against the BOP's violations of prisoners' constitutional rights; or violations of the laws, federal rules and regulations which govern the BOP, or violations of their own written BOP policy.
- Most every prisoner will be retaliated against for demanding professional medical treatment which by Federal law, Federal rules and BOP policy states the BOP MUST PROVIDE.
Not all BOP Government employees condone, or are even knowledgeable about the torture and murder being carried out throughout the BOP.
MOST government employees are deeply concerned about the going ons in our country and care deeply about human rights of others. it is the growing minority which control and take part in this torture, suffering and death depicted on this web link. some employees of the bop have helped kimball in his endeavors to uncover the truth about the bop; however, their names although held for reference, cannot be disclosed at present due to their positions being put in jeopardy.
